Terms & Conditions

1. Definitions

1.1. “Customer” means the individual or entity (or any authorised person acting on their behalf) described on any Quotation, Sales Agreement, Contract for Sale, Work Authorisation, or other form provided by Purest Water Filtration.

1.2. “Company” means Purest Water Filtration Pty Ltd.

1.3. “Goods” means all products supplied by the Company to the Customer (including water  filtration systems, replacement filters, parts, and accessories). Where relevant, this also includes  the provision of Services.

1.4. “Services” means all services supplied in connection with the Goods, including but not limited  to installation, maintenance, and repairs.

1.5. “Price” means the total amount payable for the Goods and/or Services as agreed between the  Company and the Customer in accordance with clause 4.

2. Australian Consumer Law (ACL)

2.1 Nothing in these Terms is intended to exclude or restrict the rights of consumers under the Competition and Consumer Act 2010 (CCA) or any applicable Fair Trading Acts (FTA).

2.2 These Terms apply in addition to your statutory rights under Australian Consumer Law. 

3. Acceptance

3.1 Any order placed with the Company, or any acceptance of Goods or Services supplied by the  Company, constitutes agreement to these Terms. 

3.2 Where multiple Customers are named in the contract, all parties are jointly and severally liable  for payment. 

3.3 These Terms may only be amended with written consent from the Company.

3.4 Any terms on a Customer’s purchase order that conflict with these Terms are not binding on the  Company. 

3.5 The Company may, at its discretion, engage licensed and insured contractors for installation.  Any claims for loss or damage arising from such contractors must first be addressed directly with  the contractor. 

3.6 The Company reserves the right to substitute components with comparable alternatives.  Customers will be notified in advance where possible. 

3.7 Customers may request to reschedule installation with at least 48 hours’ notice. A fee of $80 may apply if less notice is provided.

4. Price and Payment

4.1 The Price shall be as per: 

(A) the Company’s issued invoice; or 

(B) the Company’s current pricelist at the time of supply; or 

(C) A valid written Quotation that the Customer accepts within 30 days. 

4.2 The Company may adjust the Price if: 

  • Quantities or specifications change, 
  • Government taxes or duties are altered, 
  • Installation incurs additional unforeseen costs, or 
  • Supplier or freight costs increase. 

4.3 Deposits may be required at the Company’s discretion. 

4.4 Payment terms will be stated on the invoice. Payment is due within 7 days of the invoice date if  no terms are stated. 

4.5 Accepted payment methods include bank transfer, credit card, or cheque. Surcharges may  apply for certain cards (1.5% for Visa/MasterCard, 2.5% for AMEX). 

4.6 All Prices exclude GST unless stated otherwise.

5. Delivery & Installation

5.1 Delivery occurs when: 

(A) the Customer collects Goods from the Company’s premises, 

(B) the Company delivers Goods to the Customer’s nominated address, or 

(C) installation is completed by the Company or its contractors. 

5.2 Delivery fees may be added to the Price unless otherwise agreed. 

5.3 Customers must ensure safe and reasonable access for delivery and installation. Extra fees  may apply for redelivery or rescheduled appointments. 

5.4 The Company is not responsible for delays caused by events outside its control, including but  not limited to: supplier delays, weather, site access issues, or government approvals. 

6. Customer Acknowledgements

6.1 Customers acknowledge that water quality and system performance may be affected by  external factors, including source water quality, plumbing conditions, and environmental factors.

6.2 The Company provides product performance data for guidance only and makes no guarantee  of suitability unless confirmed in writing. 

6.3 It is the Customer’s responsibility to ensure that incoming water is of potable quality.

7. Installation

7.1 Customers warrant that their premises are safe and suitable for installation. If hazards (e.g.,  asbestos, unsafe wiring) are identified, installation may be delayed until resolved.

7.2 All installations must be carried out by licensed professionals.

8. Title & Risk

8.1 Risk in Goods passes to the Customer upon delivery or installation. 

8.2 Ownership of Goods remains with the Company until full payment is received.

8.3 Until ownership passes, the Customer must not sell, dispose, or encumber the Goods.

9. Warranty

9.1 Whole-home filtration systems: 5 years warranty on Goods and workmanship.

9.2 Under-sink systems: 5 years warranty on Goods and workmanship. 

9.3 Warranties are void if: 

  • Goods are misused, neglected, or altered, 
  • installation is not completed by a licensed plumber, 
  • repairs are undertaken without Company approval. 

9.4 Warranty claims require proof of purchase and evidence of defect.

10. Refund Policy

10.1 Refunds, repairs, and replacements will be provided in accordance with Australian Consumer  Law

10.2 Refunds are not provided for change of mind

10.3 Deposits or payments will be refunded if installation cannot proceed due to reasons outside  the Customer’s or Company’s control.

11. General

11.1 These Terms are governed by the laws of New South Wales

11.2 Neither party is liable for delays caused by force majeure events (including natural disasters,  strikes, or government restrictions). 

11.3 Failure to enforce any provision of these Terms does not waive the Company’s right to enforce  it later.
